These Terms of Service ("Terms") are a binding agreement between you and Ride and Go LLC ("Ride and Go", "we", "us", or "our") and govern your use of the Ride and Go mobile applications, websites, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Ride and Go is a technology platform that connects independent transportation providers ("Drivers") with users seeking transportation ("Riders") and connects users with independent restaurants for food delivery. Ride and Go does not provide transportation or food preparation services and is not a transportation carrier or restaurant.
You must be at least 18 years old to use the Service. Drivers must hold a valid driver's license, current vehicle registration, valid auto insurance meeting state minimums and any applicable Transportation Network Company (TNC) requirements, and pass a background check.
You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it current. You may not share your account.
Riders authorize Ride and Go to charge their stored payment method for all fares, delivery fees, taxes, tips, tolls, and applicable surcharges. All payments are processed by Stripe. By using the Service you also agree to Stripe's terms.
Driver compensation: Drivers earn 75% of the rider-paid fare or order subtotal for each completed trip or delivery, plus 100% of any rider-provided tip. Ride and Go retains 15% of the fare/subtotal as a platform service fee. Payouts are made by Stripe Connect to the Driver's connected bank account on Ride and Go's regular payout schedule.
Cancellation fees: Riders who cancel after a Driver has accepted may be charged a cancellation fee. No-shows are charged in full.
Drivers are independent contractors and not employees, agents, or partners of Ride and Go. Drivers are solely responsible for their own taxes, insurance, vehicle expenses, and compliance with applicable laws. Ride and Go will issue IRS Form 1099 to Drivers as required by law.
By opting in to Ride and Go text messages (at account signup, at booking, or at /sms-opt-in), you consent to receive SMS messages from Ride and Go, including account notifications, ride confirmations, driver arrival alerts, food order status updates, and delivery notifications.
Your mobile information is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Restaurants are independent businesses solely responsible for the preparation, accuracy, packaging, allergens, and food safety of orders. Ride and Go is not responsible for the content or quality of any meal.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDE AND GO LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify and hold harmless Ride and Go LLC and its officers, directors, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
Any dispute arising under these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive the right to participate in a class action. Either party may bring an individual claim in small-claims court instead. This Agreement is governed by the laws of the Commonwealth of Virginia.
You may stop using the Service at any time. We may suspend or terminate your account if we reasonably believe you have violated these Terms or applicable law, or if necessary to protect the safety of users.
We may update these Terms from time to time. Material changes will be posted in the app with a new "Last updated" date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
